Understanding Law
Laws are typically derived from general public opinion. For this reason they are not perfect and can not be interpreted in a black or white manner. Life is grey so laws need to be interpreted in the context of the situation they are being applied to.
There are four approaches to interpreting law. I will describe them in ascending order of preference to society.
Obviously complete disregard for law is anarchy and results in maximum benefit to the individual at the cost of social order
Typically most members of society fall into this category. They obey the law simply out of fear of the punishment. An example would be someone who only obeys the speed limit when he knows police are patrolling. As soon as you remove the police, they speed up.
This type of citizen is on the same intellectual par as those who obey laws out of fear of punishment . However they will still obey the law even if you remove the punishment. An example would be someone who obeys the speed limit simply because their parents always obey the speed limit. The thinking is if someone you trust and respect does it then it must be the right thing to do.
The rarest breed of citizenry obeys a law because they have fully understood why the law exists and in what situations it is meant to be applied. The unusual consequence of internalizing the law is that it allows you to break it in situations you have calculated it is not applicable. For example a driver who understands that speed limits exist for safety will find it accpetable to drive above the speed limit when conditions are clear and unbobstructed. On the other hand the same driver will also drive below the speed limit at night and inclement weather conditions for example.
The driver understands why the law exists and knows when to obey it depending on the conditions. This is the smartest way to follow the law, however, care must be taken as not to give society the impression that you are above the law.
